Complete Terms of Service

1. Acceptance of Terms

Welcome to Camvi. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Camvi Technologies Pvt. Ltd ("Camvi", "we", "us", or "our") governing your access to and use of the Camvi platform, web applications, mobile applications, APIs, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform. By using the Platform, you warrant that you meet all eligibility requirements set forth in Section 2.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, providing additional notice via email or in-app notification. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.

2. Eligibility & User Responsibilities

2.1 Eligibility

To use Camvi, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable laws
  • Have valid authorisation to act on behalf of any entity for which you use the Platform

2.2 Business Use

If you are using the Platform on behalf of a business, organisation, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and by accepting these Terms, you are doing so on behalf of that entity. In such cases, "you" and "your" refer to both you individually and the entity you represent.

2.3 User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring you comply with all applicable laws and regulations
  • The accuracy and legality of all camera feeds, footage, and content you provide
  • Maintaining appropriate backups of your data
  • Ensuring that any individuals with access to your account comply with these Terms

3. Account Creation & Security

3.1 Account Registration

To access certain features of the Platform, you must create an account by providing accurate, complete, and current information as prompted by the registration form. You agree to update your account information promptly to keep it accurate and complete. Providing false or misleading information may result in immediate termination of your account.

3.2 Account Security

You are solely responsible for maintaining the security of your account and password. You agree to:

  • Immediately notify us of any unauthorised access or use of your account at security@camvi.ai
  • Select a strong, unique password and change it periodically
  • Enable multi-factor authentication when available
  • Not share your account credentials with any third party
  • Log out of your account at the end of each session

3.3 Connected Cameras & Feeds

When you connect cameras, RTSP streams, or video feeds to the Platform, you:

  • Authorise Camvi to access and process those feeds as necessary to provide our services
  • Represent that you have the authority to grant such access
  • Confirm that connecting these feeds does not violate any third-party terms or agreements
  • Acknowledge that Camvi is not responsible for actions taken by third-party camera or NVR providers

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Platform only for lawful business purposes in accordance with these Terms, including:

  • Monitoring premises you own, lease, or are authorised to monitor
  • Generating real-time AI alerts for safety, security, and operational purposes
  • Analysing footfall, queue, and operational metrics
  • Reviewing incident clips and event logs for your own premises
  • Integrating with supported third-party tools (WhatsApp, email, webhooks)

4.2 Prohibited Activities

You agree not to use the Platform to engage in any of the following prohibited activities:

Illegal Activities

  • Engage in any activity that violates applicable laws, regulations, or third-party rights
  • Conduct surveillance of individuals without lawful basis or proper consent under DPDP / GDPR
  • Facilitate fraud, money laundering, or deceptive practices
  • Violate export-control or sanctions regulations

Privacy Violations

  • Monitor private spaces (homes, changing rooms, washrooms, hotel rooms) without explicit consent and signage
  • Use facial recognition or biometric features in jurisdictions where prohibited
  • Resell raw camera footage of individuals to third parties
  • Collect or process personal data of children without verifiable parental consent

Platform Abuse

  • Attempt to reverse-engineer, decompile, or extract source code from the Platform
  • Circumvent any security measures or access controls
  • Use automated systems to scrape or collect data from the Platform
  • Interfere with or disrupt the Platform's operation
  • Resell, sublicense, or redistribute Platform access without authorisation
  • Introduce viruses, malware, or other malicious code

5. AI Detection Disclaimer

5.1 Nature of AI Detection

Camvi uses artificial intelligence and machine learning models to generate real-time detections, pre-alerts, and incident classifications. You acknowledge and understand that:

  • AI-generated detections may not always be perfect, accurate, or suitable for your specific premises
  • Outputs are based on patterns learned from training data and may occasionally produce unexpected, incorrect, or inaccurate results (false positives and false negatives)
  • Detection technology is constantly evolving, and outputs may vary over time
  • Camvi's pre-alerts are advisory — they are not a substitute for professional security personnel, fire-safety systems, or emergency services

5.2 Your Responsibility

You are solely responsible for:

  • Reviewing AI-generated alerts and incident clips before acting on them
  • Maintaining redundant safety systems (smoke alarms, security guards, fire suppression) regardless of Camvi's coverage
  • Verifying the accuracy of incident classifications, statistics, and factual statements
  • Any consequences resulting from acting (or failing to act) on Camvi's outputs

5.3 No Guarantee of Outcomes

While our AI is designed to optimise incident prevention and operational efficiency, we do not guarantee any specific outcome, including:

  • Detection of every incident or unsafe condition
  • Prevention of all theft, loss, fire, or safety events
  • Specific reductions in shrinkage, claims, or compliance violations
  • Continuous accurate operation under all lighting, weather, or hardware conditions

6. Privacy, DPDP & Data Protection

6.1 Compliance Responsibility

You acknowledge and agree that you are solely responsible for ensuring that your use of the Platform complies with all applicable privacy laws and regulations, including but not limited to:

  • India's Digital Personal Data Protection Act, 2023 (DPDP Act)
  • EU General Data Protection Regulation (GDPR), where applicable
  • Any state, sectoral, or local data-protection rules in your jurisdiction
  • Workplace surveillance and employee-consent laws
  • Public-area signage requirements where CCTV is operating

6.2 Data Residency

By default, Camvi processes inference and stores incident metadata in Mumbai-region datacentres located in India. Enterprise customers may opt for fully on-premises deployment, in which case no inference or footage leaves the customer's network.

6.3 Camera Footage & Personal Data

You retain ownership of all camera footage, incident clips, and metadata you generate using the Platform. Camvi processes this data on your behalf solely to provide the services. You agree to:

  • Display appropriate notices and signage informing individuals of CCTV monitoring
  • Honour data-subject access, correction, and deletion requests under applicable law
  • Retain footage only for the period legally permitted in your jurisdiction
  • Delete footage from the Platform when no longer needed

7. Intellectual Property Rights

7.1 Camvi Intellectual Property

The Platform, including its original content, features, functionality, AI models, algorithms, software, user interface, and design, is owned by Camvi and protected by international copyright, trademark, patent, trade-secret, and other intellectual-property laws.

Specifically:

  • The Camvi name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Camvi
  • Our trademarks and trade dress may not be used without our prior written consent
  • All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners

7.2 Your Content

You retain ownership of all content you upload to the Platform, including footage, incident clips, screenshots, annotations, and metadata ("Your Content"). By uploading Your Content, you grant Camvi a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

  • Use, reproduce, modify, adapt, and process Your Content solely for the purpose of providing and improving our services
  • Process Your Content through our AI systems to generate detections and incidents
  • Store and back up Your Content as necessary for Platform operation

This license terminates when you delete Your Content or your account, except for content that has been shared with others who have not deleted it, or content we are required to retain for legal purposes.

7.3 Model Training & Aggregation

Subject to your compliance with these Terms and payment of applicable fees:

  • You own the rights to AI-generated outputs created through your use of the Platform for your business purposes
  • We retain rights to the underlying AI models, algorithms, techniques, and technology used to generate such outputs
  • We may use anonymised and aggregated data about Platform usage to improve our services, provided no individual or customer is identifiable

8. Subscription, Billing & Refunds

8.1 Subscription Plans

Camvi offers various subscription plans with different features, camera limits, and pricing tiers. Current pricing and plan details are available on our website at /pricing. We reserve the right to modify pricing with at least 30 days' notice to existing subscribers, effective from the next billing cycle.

8.2 Billing & Payment

By subscribing to a paid plan, you agree to:

  • Pay all applicable fees in INR as described at the time of purchase
  • Be billed in advance on a monthly or annual basis depending on your selected plan
  • Provide accurate and complete billing information and keep it current
  • Authorise us to charge your payment method for all fees incurred
  • Pay GST and any other applicable taxes at the rate in force

8.3 Automatic Renewal

Unless you cancel your subscription before the end of the current billing period:

  • Your subscription will automatically renew for another period at the then-current rate
  • We will charge your payment method on file for the renewal fee
  • You can cancel auto-renewal at any time through your account settings
  • Cancellation will take effect at the end of the current billing period

8.4 Refund Policy

Given the nature of our digital services, subscription fees are generally non-refundable. However, we may consider refund requests on a case-by-case basis for:

  • First-time subscribers within 7 days of initial subscription if the service significantly fails to perform as described
  • Cases of accidental duplicate charges
  • Extended service outages caused by Camvi (exceeding 72 consecutive hours)

To request a refund, contact billing@camvi.ai with your account details and reason for the request.

9. Camera, RTSP & Hardware Terms

Camvi works with your existing CCTV cameras over RTSP. You acknowledge that:

  • You are responsible for the operation, maintenance, and reliability of your camera hardware and network
  • Camvi does not provide cameras, NVRs, or networking equipment unless explicitly purchased through us
  • Outages caused by hardware failure, network failure, or power loss on your premises are not the responsibility of Camvi
  • Camera placement must comply with all applicable privacy and surveillance laws
  • You will use only RTSP streams you have lawful authority to monitor

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAMVI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, business opportunities, or goodwill
  • Loss arising from any failure to detect or prevent an incident
  • Loss or corruption of data or footage
  • Cost of substitute services or alternative platforms
  • Damages caused by reliance on AI-generated outputs

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO CAMVI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹10,000 INR, WHICHEVER IS GREATER.

11. Termination of Accounts

11.1 Termination by You

You may terminate your account at any time by:

  • Using the account-deletion option in your account settings
  • Contacting our support team at support@camvi.ai

Upon termination, your right to use the Platform will immediately cease. You will remain liable for all fees incurred prior to termination. No refunds will be provided for any unused portion of your subscription.

11.2 Termination by Camvi

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms or our policies
  • Engagement in fraudulent, illegal, or harmful activity
  • Failure to pay applicable fees after reasonable notice
  • Violation of Platform policies resulting in account suspension
  • Posting a security risk to the Platform, other users, or third parties
  • Extended period of account inactivity (12+ months)
  • Request by law-enforcement or government agency
  • Discontinuation of the Platform (with reasonable notice)

11.3 Effect of Termination

Upon termination:

  • All licenses granted to you under these Terms will terminate
  • We may delete your account and all associated data within 30 days
  • We may retain certain information as required by law
  • Connected third-party accounts will be disconnected from Camvi
  • Any pending or incomplete transactions may be cancelled

12. Governing Law & Jurisdiction

12.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.

12.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the competent courts located in Mumbai, Maharashtra, India. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

12.3 Dispute Resolution

Before initiating any legal proceeding, you agree to:

  • First attempt to resolve any dispute informally by contacting us at legal@camvi.ai
  • Allow at least 30 days for us to attempt to resolve the dispute through good-faith negotiations
  • Provide a written description of the dispute, including relevant facts and your proposed resolution

12.4 Waiver of Class Actions

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CAMVI AGREE THAT:

  • EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY
  • NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING
  • ANY ARBITRATION OR COURT PROCEEDING WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS

If this class-action waiver is found to be unenforceable, then the entirety of this dispute-resolution section shall be null and void.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and, for material changes, provide additional notice via email or prominent in-app notification at least 30 days in advance where reasonably possible.

Your continued use of the Platform after any modifications become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and may terminate your account.
